NSW Fair Trading Issues 40 Warning Letters and 36 Penalty Notices

The regulatory body of NSW Fair Trading has recently highlighted its ongoing enforcement actions, aimed at maintaining industry standards and protecting consumers. This serves as a timely reminder for all members to ensure their compliance with relevant laws, regulations and our Code of Ethics.
During January and February 2025, Fair Trading issued 40 warning letters and 36 penalty infringement notices, totaling $74,800.
These enforcement actions demonstrate the seriousness with which non-compliance is treated. Notably, a licensee was disqualified for 4 years and 6 months due to multiple breaches, including producing false vehicle inspection reports. This case underscores the importance of accurate and compliant vehicle inspections.
Furthermore, Andrew Leech was convicted of unlicensed motor dealing and odometer tampering. Investigations revealed he sold 16 vehicles without a license and tampered with an odometer, winding back the reading by more than 200,000 kilometres. This resulted in 9-months imprisonment, a $1,170 fine, and $1,000 in professional costs.
Hossein Arabshahi was also convicted for using false documents to influence an investigation. He provided false Form 5 Motor Dealer Notices, leading to a $2,500 fine and $500 in professional costs.
